These terms and conditions (the “Child’s Account Terms”) constitute a legal agreement between the Parent/ Guardian (“you”) and Whish Money S.A.L. (“we”,“our”, or “us”) for the Services provided to the Users (asdefined below).
By creating or managing a child or teen account, you agree to be bound by these Child’s Account Terms on your own behalf and on behalf of the kid or teen for whom you are acting as Parent/Guardian.
Please read these Child’s Account Terms carefully, together with our Privacy Policy, Children’s Privacy Policy, Cookie Policy, and other additional policiesapplicable to you. These policies form an integral part of these Child’s Account Terms by reference. These Child’s Account Terms apply in addition to, and not in place of, the aforementioned policies. If there is any inconsistency between the general Terms & Conditions and these Child’s Account Terms, these Child’s Account Terms will apply.
For the purposes of these Child’s Account Terms:
The Parent/Guardian is the legal owner of the Account. By setting up the Account, you, the Parent/Guardian, must designate a specific User who will be authorized to use the Account. You must also confirm that you have the legal authority toconsent to these Child’s Account Terms on behalf of the User you add to theAccount. You are responsible for ensuring that the User complies with these Child’s Account Terms. Upon request, the Parent/Guardian must also provide any necessary information to verify the identity of the User, in accordance with applicable legal and regulatory requirements.
To create and manage an Account, you, theParent/Guardian, must hold a valid, active, and verified Whish Money personal account in your own name. If the Parent/Guardian elects to close their personal account, the Account will be unlinked.
Each individual Account may be linked to a maximum of two Parent/Guardian Accounts. The Parent/Guardian is restricted to five (5) Account links under their primary account.
Each Account may only be assigned to one User, and once a User is nominated, that individual cannot be changed. TheParent/Guardian may grant access to a duly authorized co-parent/co-guardian. In such case, the co-parent/co-guardian will be bound by these Child’s AccountTerms.
The Account is designed for parents and guardians who wish to support their child’s financial independence. It enables the Parent/Guardian to maintain oversight of transactions and Account activity, as set out in these Child’s Account Terms.
Using the Account for any other purpose may constitute a breach of these Child’s Account Terms and could result in suspension or termination of the Account.
The Account is designed for use by Users, strictly under supervision of a Parent/Guardian. To ensure an age-appropriate and controlled environment, the Account is subject to specific features and usage limitations. These may include, but are not limited to:
Over-the-counter transactions (whether in branches or agents) are strictly prohibited.
We reserve the right to modify, add, or remove these features and limitations at our discretion, with or without notice, to ensure continued compliance with regulatory standards and to maintain a safe User experience.
As the Parent/Guardian, you are solely responsible for the activities carried out by the User on the Account and any associated Children’s Cards. Each Children’sCard is issued to the Parent/Guardian, who authorizes the User to use it on their behalf. By doing so, the Parent/Guardian accepts full liability for all actions taken by the User using the Children’s Card, as if those actions had been taken by the Parent/Guardian themselves.
Our Services provide you with certain tools for parental control and oversight, but these tools are not a substitute for active supervision. You are responsible for actively monitoring User transactions, and ensuring the Account is used in accordance with these Child’s Account Terms.
The Parent/Guardian can stop the use of an Account at any time by freezing the Children’s Card through the Whish App.
The Children’s Card enables Users to make certain purchases as outlined in these Child’s Account Terms (the “Children’s Card”).
The User nominated for the Account is the only person permitted to use the Children’s Card. A Children’s Card may be used by the User to make purchases in-store or online, as well as to withdraw cashfrom Cash Kiosks. These features can be enabled or disabled at any time by the Parent/Guardian through the Whish App.
Subject to third-party terms, a Children’s Card may also be compatible with Google Pay, allowing the User to make payments via their mobile device, provided that their respective terms and eligibility requirements are met. This means that Users may be able to make purchases using a digital wallet.
To promote a safe experience, certain merchant types may be automatically blocked. For example, purchases from businesses that primarily sell gambling products may be restricted. While we make reasonable efforts to maintain these restrictions, we cannot guarantee that all inappropriate transactions will be blocked.
Users may make and receive transfers and payments to and from other Users. Users may also be able to make or receive funds through a “payment link”. Furthermore, the Parent/Guardian can send funds to the Account and can monitor all transactions.
We accept no liability for how or where the Children’s Card is used by the User, or for any payments made using the Account. As Parent/Guardian, you are solely responsible for managing the Account and ensuring it is used in accordance with the applicable laws and these Child’s Account Terms. This includes, but is not limited to, the following responsibilities:
The Parent/Guardian represents and warrants that they are the legal parent or guardian of the User and possess the full legal authority to enter into these Child’s Account Terms, establish the Account, and otherwise act on behalf ofthe User in all matters related to the Account and the use of the Service.
To provide the Services under these Child’s Account Terms, we are required to collect certain personal data from Users in compliance with data protection laws. Accordingly, Parents/Guardians are required to provide the necessary personal data to enablethe setup and ongoing operation of an Account.
We are committed to protecting the privacy of our Users and have therefore developed a dedicated Children’s Privacy Policy tailored specifically for our younger users. This Children’s Privacy Policy explains, inter alia, how and why we collectand process personal data, as well as the rights available to data subjects under applicable data protection laws. As the Parent/Guardian, it is your responsibility to ensure that the User comprehends the Children’s Privacy Policy, providing guidance where necessary.
As the User grows older, their eligibility for certain features or account types may change. Upon turning 18, the User may be eligible to upgrade to a full Whish Money personal account, subject to our standard eligibility requirements and acceptance of the general Terms and Conditions.
These Child’s Account Terms, and any non-contractual obligations or claims arising out of or in connection with the said terms, are exclusively governed by and construed in accordance with the laws of the Republic of Lebanon, without regard to its conflict of law principles.
Any dispute, actions, or proceedings arising from or in connection with these Child’sAccount Terms or the use of the Service(s), including any non-contractual disputes or claims, shall be resolved exclusively in the courts of Beirut.
We reserve the right to update these Child’s Account Terms at any time. When we do, we will post the revised Child’s Account Terms on our website and update the “Date of Last Revision” at the top of this page.
The continued use of the Services after any such changes constitutes your acceptance of the new Child’s Account Terms.
These Child’s Account Terms are personal to the Parent/Guardian and may not be assigned or transferred to any other person. You may not transfer any of your rights or obligations under these Child’s Account Terms.
The Services are provided on an “as is” and “as available” basis. We do not make any warranties, express or implied, regarding the Services’ reliability, accuracy, or suitability for any particular purposes.
To the fullest extent permitted by law, we disclaim all liability for any damages or losses, whether direct, indirect, incidental, or consequential, that arise from the use of the Services.
We reserve the right to terminate or suspend access to the Services and the Account at anytime, for any reason, with or without notice.
Reasons for termination may include, but are not limited to, a breach of these Child’sAccount Terms, illegal activity, or our discontinuation of the Services. You may also terminate the Account at any time by contacting our support team.
